Registration Exercise

  • All interested developers with residential properties in Peninsular Malaysia may register their properties with REHDA Malaysia by filling in the online form at 'Registration & Certification Exersises' <https://hoc.rehda.com/#registration/>.
  • The registration form must be accompanied by the following:
    • Under Construction projects :-
      i)  copy of (D01)
      valid Developer's Licence (DL) and Advertisement & Sale Permit (AP) [certified true copy by a solicitor] ; and
      ii) copy of (D02)
      price listing submitted to KPKT for APDL application [certified true copy by a solicitor].
    • Completed projects :-
      i) copy of latest (D01) Developer's Licence (DL) and Advertisement & Sale Permit (AP) [certified true copy by a solicitor](*renewal of the APDL is not required for the purpose of HOC 2020-2021)and
      ii) copy of (D03) Certificate of Completion and Compliance (CCC) or Certificate of Fitness (CF) [certified true copy by a solicitor].
    • Others - Copy of APDL Not in Possession/Missing (X-APDL)* :-
      i) (D05) Supporting document: Developer Letter Confirming the APDL is No Longer in Possession with Relevant Information; and
      ii) (D03) Supporting document: copy of Certificate of Completion and Compliance (CCC) or Certificate of Fitness (CF) [certified true copy by a solicitor].
    • Others - Build Then Sell (BTS) developments* :-
      i) (D06) Supporting document: Copy of Approval Cover Letter from PBT to Architect 
      [certified true copy by a solicitor];
    • ii) (D07) Supporting document: Developer Letter Confirming No Unit(s) Sold/Transacted during Construction; and
      iii) (D03) Supporting document: Copy of Certificate of Completion and Compliance (CCC) or Certificate of Fitness (CF) [certified true copy by a solicitor].
    • Others - Developments of 4 units and below (4UB)* :-
    • i) (D06) Supporting document: Copy of Approval Cover Letter from PBT to Architect [certified true copy by a solicitor]; and
    • ii) (D08) Supporting document: letter from Architect (registered with the Board of Architect Malaysia) to confirm that the total number of units for the development is 4 units and below [certified true copy by a solicitor].
    • (A11) Proof of Payment* (bank official receipt): Payment of the relevant fee as stated in Administrative Fee**
    • Submission by project must include: (C15) Details of Units (in Excel Template) and (C16) Declaration of Unsold Units Form.
    • if applicable, (A02) Company Name: Supporting document to establish the relationship between the companies is required IF the company name differs in the APDL/CCC (ie: JV agreement) [certified true copy by a solicitor].
    • if applicable,(A06) Proof of Relationship with Member: Supporting document to establish the relationship between REHDA Member and the participating developer (ie: copy of the latest annual returns submitted to Registrar of Companies or ownership of shareholdings) [certified by the company secretary).
    • if applicable, (D04) copy of a letter from the relevant State Authority on controlled price [certified true copy by a solicitor].
  • Price reflected in the SPA is the discounted price.
  • For the purpose of the registration exercise,'per project' is defined as 'per developer's licence'.
  • The Sale & Purchase Agreement affecting the transaction MUST be executed (signed) between the purchaser and the developer on or after 1 June 2020 but not later than 31 May 2021.
  • Incomplete submission and documentation(s) not in accordance to required format given will NOT be processed.
  • The registration exercise with REHDA Malaysia is opened up to Thursday, 15 April 2021, 6.00 pm.
      * Payment for Registration Exercise is payable to:-
              REHDA Malaysia’s Public Bank Account No: 3088280408
             [Name on bank draft/cheque: REHDA Malaysia].
    **Administrative fee is to be paid by the developer (and not by the purchaser) and non-refundable.

Important Note:
Developers are advised to fill in all details accurately (including detailed APDL pricing for each unit as approved by KPKT) as all information will be submitted to the Ministry Housing and Local government (KPKT).

Certification Exercise

  • Upon the sale of a property which has been registered with REHDA, the developer shall prepare the ‘Certification for Stamp Duty Waiver’ as in the attached format in quadruplicate and must be FULLY TYPED/PRINTED. Writing using black or blue ink is allowed ONLY in the signatory section and is subject to Branch's discretion.  [VIEW SAMPLE]  [DOWNLOAD FORM]
  • Developers are required to submit purchasers’ details by filling in the online form at 'Registration & Certification Exersises' <https://hoc.rehda.com/#certification/>.
  • All 4 copies of the ‘Certification for Stamp Duty Waiver’ with original signatures and company stamp (please use separate sheet for each transaction) together with a copy of the Sale & Purchase Agreement (relevant pages with details of purchaser, developer, property and signatures), proof of payment* made to respective Branch and a certified (certified true copy by a solicitor) copy of letter from State Authority on controlled price (if applicable) and/or authorization letter for company signatory (if applicable) must be submitted to the REHDA Branch in the state where the property is situated for certification within 30-days from the SPA stamping date.
  • The developer’s signatory for the Certificates is required to be the same signatory executing the corresponding SPA. In the event the signatory for the Certificates is not the same as the person executing the SPA, the company would have to issue a letter (printed on respective company letterhead) to the REHDA Branch concerned to authorise the said person/ individual to sign the Certificates on behalf of the company.   • Incomplete submission and documentation(s) not in accordance to required format given will NOT be processed.
  • The REHDA Branch concerned shall return 2 copies of the certification to the developer, to be produced to the relevant stamp duty offices for the purpose of stamp duty exemption.
  • The closing date for the Certification Exercise with the relevant REHDA Branches is 30 days from SPA stamping date or 30 July 2021, Friday 5.00 pm, whichever is earlier. Please note that no late submissions will be entertained after 30 July 2021.
  • For SPAs stamped between 1 June to 13 November 2020, the deadline for Certification Exercise with the relevant REHDA Branches is 14 December 2020.

    * Payment of the relevant fee as stated in the Certification Exercise Administrative Fee. Administrative fee is to be paid by the developer (and not by the purchaser) and is non-refundable.
    ** Payment for Certification Exercise is payable to respective REHDA Branches. Please refer to the ‘HOC 2020-2021 Registration Confirmation’ e-mail upon approval of registration for details.
