The Ministry of Urban Wellbeing, Housing and Local Government (KPKT) has implemented an additional requirement with regards to advertisements by developers in the mass media as well as social media platforms.
Developers who wish to advertise their development projects through mass media and social media are required to obtain approval from the Ministry’s National Housing Department (JPN) through the application of the Advertisement and Sale Permit in line with Regulation 5 of the Housing Development (Control and Licensing) Regulations 1989, Act 118.
Any advertisements by developers or their advertising and marketing agents through mass media (radio, television, broadcasting, etc.) as well as social media (Facebook, Instagram, Twitter, etc.) MUST obtain the necessary approval with the statement “IKLAN INI TELAH DILULUSKAN OLEH JABATAN PERUMAHAN NEGARA” to be included in the advertisement. This new requirement takes effect from 9 October 2017.
Failure to comply with the above is an offence under Regulation 13 of the Housing Development (Control and Licensing) Regulations 1989, Act 118 which upon conviction carries a fine of not more than RM50,000 or a term of imprisonment not exceeding 5 years, or both.
